Indirect Taxes in India Today

Since 1 July 2017, GST has replaced most central and state indirect taxes, including service tax, most central excise, VAT, CST and entry tax. But several important indirect taxes still sit outside GST.

Special Valuation Branch (SVB): Related-Party Imports

The Special Valuation Branch is a unit of Indian Customs that examines the valuation of goods imported between related parties.

Under Section 14 of the Customs Act, 1962, customs duty is levied on the transaction value of imported goods. When the Indian importer and the foreign supplier are related, for example as subsidiary and parent, the price may be influenced by that relationship. If goods are imported below normal market value, less duty is paid. The SVB's role is to check whether the relationship has affected the invoice value.

The Customs Valuation (Determination of Value of Imported Goods) Rules, 2007 require importers to declare relevant information in the bill of entry, on the basis of which duty is assessed. Related-party transactions also involve sole agents, sole distributors and arrangements such as collaboration, technical know-how, licensing and joint venture agreements with the foreign supplier. Royalties and licence fees connected with imported goods may need to be added to the customs value.

Customs valuation and transfer pricing look at the same related-party prices from opposite directions, so a year-end TP adjustment can affect the customs value. We review both together to avoid surprises.

04

Who Is Considered “Related” for Customs Valuation?

Under Rule 2(2) of the Customs Valuation Rules, an importer and supplier are treated as related if, among other things:

  • They are officers or directors of one another's businesses
  • They are legally recognised partners in business
  • They are employer and employee
  • Any person directly or indirectly owns, controls or holds 5% or more of the outstanding voting stock or shares of both of them
  • One of them directly or indirectly controls the other
  • Both are directly or indirectly controlled by a third person
  • Together they directly or indirectly control a third person
  • They are members of the same family

Sole agents, sole distributors and sole concessionaires may also be treated as related if they meet these criteria. Indian subsidiaries of foreign groups that import from group companies should review their position.

Frequently Asked Questions

Which indirect taxes still apply in India after GST?
GST covers most supplies, but customs duty on imports, central excise on specified petroleum and tobacco products, and state VAT on alcoholic liquor and specified petroleum products continue to apply. Pre-GST laws also still govern pending assessments, appeals and refunds for earlier periods.
What is the Special Valuation Branch (SVB) of Customs?
The SVB is a unit of Indian Customs that examines whether the relationship between an importer and a related foreign supplier has influenced the price of imported goods, and therefore the customs duty paid.
Who needs to go through SVB?
Importers who are related to their foreign suppliers under Rule 2(2) of the Customs Valuation Rules, 2007, for example through shareholding of 5% or more, control, common directors or family relationships, may need their imports examined by the SVB.
Can transfer pricing adjustments affect customs duty?
Yes. Customs and transfer pricing both look at related-party prices. A transfer pricing adjustment that changes the price of imported goods can affect the customs value and the duty payable, so the two should be managed together.
What export incentives are available under the Foreign Trade Policy?
Common schemes include duty drawback, RoDTEP (Remission of Duties and Taxes on Exported Products), Advance Authorisation for duty-free import of inputs, and EPCG for capital goods imports against an export obligation. Eligibility depends on the product and the conditions of each scheme.
Can you help with old service tax, excise or VAT cases?
Yes. We handle pending pre-GST assessments, appeals and refund claims under service tax, central excise, VAT and CST, including representation before appellate authorities.
