Why Labour Law Compliance Matters

Labour laws are the rules, regulations and judgments that protect the rights of workers and set the obligations of the businesses that employ them. They apply to organisations of every size and industry.

  • Legal requirement. Every establishment must comply with applicable labour laws, and it is the employer's responsibility to meet all its legal obligations.
  • Avoiding financial loss. Non-compliance can lead to fines, penalties and back payments that increase the cost of doing business.
  • Protecting reputation. Compliance protects the organisation's reputation with employees, customers and investors.
  • A safe, productive workplace. Labour laws set standards for a healthy, safe and fair workplace, which also improves productivity.

The Four Labour Codes

India has consolidated 29 central labour laws into four Labour Codes, which have been brought into force. Central and state rules under the Codes continue to be notified, so employers need to manage the transition carefully.

Labour CodeWhat it coversKey earlier laws it replaces
Code on Wages, 2019Minimum wages, payment of wages, bonus and equal remuneration, with a uniform definition of “wages”Payment of Wages Act, Minimum Wages Act, Payment of Bonus Act, Equal Remuneration Act
Code on Social Security, 2020Provident fund, ESI, gratuity, maternity benefit, employee compensation, and gig and platform workersEPF Act, ESI Act, Payment of Gratuity Act, Maternity Benefit Act, Employee's Compensation Act, Employment Exchanges Act
Occupational Safety, Health & Working Conditions Code, 2020Safety, health, working hours and conditions, contract labour and factoriesFactories Act, Contract Labour (Regulation & Abolition) Act and related laws
Industrial Relations Code, 2020Trade unions, standing orders, industrial disputes, lay-off and retrenchmentIndustrial Disputes Act, Trade Unions Act, Industrial Employment (Standing Orders) Act

State Shops & Establishment Acts, the Apprentices Act and the POSH Act continue to apply alongside the Codes. The new wage definition can change PF, gratuity and bonus costs, so salary structures should be reviewed with our payroll team.

POSH Act Compliance

The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 built on the Supreme Court's Vishaka Guidelines. It makes employers responsible for providing women with a safe workplace and protecting their right to equality and dignity.

What Counts as Sexual Harassment

Under the Act, sexual harassment includes any one or more of these unwelcome acts or behaviour, whether directly or by implication:

  • Physical contact and advances
  • A demand or request for sexual favours
  • Making sexually coloured remarks
  • Showing pornography
  • Any other unwelcome physical, verbal or non-verbal conduct of a sexual nature

Implied or explicit promises of preferential treatment, threats of detrimental treatment, or creating a hostile work environment in connection with such conduct can also amount to sexual harassment.

Employer Responsibilities

  • Implement a POSH policy at the workplace
  • Constitute an Internal Committee (IC) where there are 10 or more employees
  • Display the consequences of sexual harassment and the IC members' details
  • Run regular training and awareness programmes for employees and IC members
  • Act promptly and fairly on any complaint received
  • Submit the annual report to the District Officer, and make the required disclosures in the company's Board's report

Frequently Asked Questions

What do labour law compliance services include?
They typically include registrations and renewals under state Shops & Establishment laws and the Labour Codes, statutory registers and returns, minimum wage and payroll compliance, PF and ESI, factory and contract labour compliance, POSH Act compliance, and support during inspections.
Have the new Labour Codes come into force?
Yes. The four Labour Codes, covering wages, social security, occupational safety and industrial relations, have been brought into force, consolidating 29 earlier central laws. Central and state rules continue to be notified, and some earlier requirements apply during the transition, so employers should review their compliance and wage structures.
Is a POSH Internal Committee mandatory?
Yes, for every workplace with 10 or more employees. Where an organisation has fewer than 10 employees, complaints are handled by the Local Committee constituted by the District Officer.
What is the penalty for not complying with the POSH Act?
An employer that fails to comply can be fined up to ₹50,000. Repeated non-compliance can attract higher penalties, and cancellation of the business licence or registration.
Does a private company need to report POSH compliance?
Yes. The Internal Committee must prepare an annual report for the employer and the District Officer, and companies must include specified POSH disclosures in their Board's report.
How do the Labour Codes affect salary structures?
The Codes use a uniform definition of wages, under which excluded allowances above a set share of total pay are added back to wages. This can increase PF, gratuity and other wage-linked costs, so CTC structures should be reviewed.

Are your establishments fully compliant?

Share your locations and headcount. We will review your labour law and POSH position and flag the gaps, at no cost and with no obligation.
