Direct Tax in India: Why Expert Advice Matters

India's direct tax laws change frequently to reflect economic and policy priorities, and they place extra conditions on both domestic and cross-border transactions. Managing the tax function well, and on time, is a real challenge for most businesses.

The Income-tax Act, 2025 has replaced the Income-tax Act, 1961 from 1 April 2026. Filings and assessments for earlier years continue under the old law, while the new law introduces the concept of a single “tax year” and renumbers many sections and forms. Businesses now need to work across both regimes during the transition.

AAPT & Associates advises on all direct tax matters. We help with tax-efficient structuring, timely compliance, identification and evaluation of tax risks, and effective controls, working closely with your team so the results are practical and productive.

Form 10F and Tax Residency Certificate (TRC) for Non-Residents

Foreign companies, entities and individuals working with Indian businesses are subject to withholding tax on many payments. A tax treaty may allow a lower rate, or no tax at all, but only if the right documents are in place.

The tax to be withheld depends on the nature of the income, the rate under Indian tax law, and the rate under the Double Taxation Avoidance Agreement (DTAA) between India and the payee's country of residence. To claim treaty benefits, the non-resident must provide a Tax Residency Certificate from its home country, accompanied by Form 10F filed online on the Indian income tax portal. Indian payers will usually insist on both before remitting payment.

Filing With PAN

Most non-residents claiming treaty benefits need to report that income in India and therefore hold a PAN. The login created on the income tax portal for their return can also be used to file Form 10F.

Filing Without PAN

Non-residents who are not required to obtain a PAN, or have not yet obtained one, can file Form 10F on the same portal without creating a full login, using basic details and supporting documents.

Details Required

  • Status (company, individual, etc.)
  • Nationality or country of incorporation
  • Tax Identification Number in the home country
  • Address in the home country
  • Period of residence, with a copy of the TRC

Our team has helped many foreign individuals and entities obtain TRCs and file Form 10F, so their Indian customers can apply the correct treaty rate. We also advise on permanent establishment risk, which can affect whether treaty benefits are available.

Frequently Asked Questions

What do direct tax advisory services include?
Direct tax advisory services typically include corporate tax planning and returns, advance tax, withholding tax (TDS) compliance, certifications such as Form 15CA/15CB, treaty and Form 10F support, transaction tax structuring, and representation in assessments and appeals.
What is Form 10F and who needs to file it?
Form 10F is filed online by a non-resident who wants to claim tax treaty benefits on income from India. It accompanies the Tax Residency Certificate from the non-resident's home country, and allows the Indian payer to apply the treaty rate of withholding tax.
When are Form 15CA and 15CB required?
Form 15CA is a declaration filed by the payer for most remittances to non-residents. For many taxable remittances above prescribed limits, it must be supported by Form 15CB, a certificate from a Chartered Accountant confirming the nature of the payment and the tax withheld.
How has the Income-tax Act, 2025 changed things?
The Income-tax Act, 2025 replaced the 1961 Act from 1 April 2026. It introduces a single “tax year” concept and renumbers many sections and forms, while largely retaining the main tax principles. Earlier years continue to be governed by the old Act, so businesses need to manage both during the transition.
Can we get a lower TDS rate on payments we receive?
Yes. If your expected tax liability is lower than the TDS that would be deducted, you can apply to the tax department for a lower or nil deduction certificate. We prepare and file the application and follow up on it.
How much can an NRI repatriate from an NRO account?
NRIs and PIOs can generally remit up to USD 1 million per financial year from NRO account balances, including sale proceeds of assets, subject to tax being paid. The remittance requires Form 15CA and, in most cases, a CA certificate in Form 15CB.
